Inaccurate Breath Test Results

Challenging DUI Breath Test Results

In any DUI case, the state's most critical piece of evidence is usually the breath test result. Without it, in fact, the case falls apart.

Of course, every competent DUI defense attorney knows this and will look for ways to effectively challenge their clients' breath test results. Far fewer, however, will actually have what it takes to accomplish that goal.

At Ronnie Rae & Associates, you will find experienced attorneys who know how to effectively challenge this key piece of evidence. Our firm has handled hundreds of DUI cases in central and eastern Washington, and many on the state's west coast as well. More importantly, we have effectively challenged breath test evidence on behalf of countless previous clients in these areas.

Breath tests are anything but infallible. Talk to our lawyers about your DUI arrest and your options for minimizing or avoiding the consequences of a DUI conviction. For a free consultation, just call or contact us online.

Why Do Breath Tests Give Inaccurate Results?

Breathalyzer machines can produce inaccurate blood-alcohol readings for a number of different reasons including poor calibration and maintenance of the machines themselves, exposure to certain chemicals or chemical compounds, adherence to a low-carb diet, dental irregularities, gastrointestinal disorders, and even air bag deployment.

Of these, two of the most common but least-recognized causes of an inaccurate breath test result involve the measurements of alcohol released by gastroesophageal reflux disease (GERD, a.k.a. acid reflux) and measurements of alcohol trapped inside of the mouth by irregular dental pockets, chewing tobacco residue or dentures.

The problem is that the results these machines give are based on the assumption that the alcohol they measure comes from the lungs. When it comes from another source such as the stomach or as residual mouth alcohol, there can be a dramatic effect on blood-alcohol content (BAC) measurements.

In sum, if you have been arrested on drunk driving charges and feel as though the breath test results in your case cannot possibly be right, you may be right about that and should consider talking to our lawyers.
