What Counts as Domestic Violence?

Even though the law defines it in much broader terms, domestic violence is usually thought to mean only physical violence that occurs between a husband and a wife. In truth, domestic violence includes more than just physical assaults, sexual assaults or damage to property. It includes emotional and psychological forms of abuse such as threats of violence, stalking and harassment.

Similarly, acts of domestic violence and assaults are not limited to husband and wife relationships. The law recognizes that they can happen between anyone — roommates, dating partners, ex-partners and ex-spouses, extended family members, casual acquaintances and others too.

Assault Charges

Assault charges will often be filed after an incident of domestic violence. In Washington State, the crime of assault is divided into four categories: 1st, 2nd, 3rd (all felonies) and 4th degree (a gross misdemeanor) assault. The level of charges will generally depend on the alleged level of force used, the injuries suffered and other facts specific to the case.

Other Domestic Violence-Related Charges

As already noted, physical violence is only one form of domestic violence. Some other common types of DV charges include: interfering with reporting domestic violence; harassment; malicious mischief (1st, 2nd and 3rd degree types); and violation of a no contact order or restraining order.
